Conflicto de competencia suscitado entre el Juzgado Segundo Civil Municipal de Pereira y el Juzgado Segundo Civil Municipal de Manizales.
La controversia entre las precitadas autoridades tuvo su origen en las diferentes interpretaciones del factor territorial.
Teniendo en cuenta que ambos despachos son competentes para tramitar la acción de tutela, la Corte decidió dar prevalencia a la elección hecha por el accionante, en virtud de la cláusula de competencia a prevención.
Con base en lo anterior remitió el expediente al Juzgado Segundo Civil Municipal de Pereira, con el fin de que, de forma inmediata, continúe con el trámite respectivo y dicte la decisión de fondo a la que haya lugar.
